Warranties, Storage, and Liability

The Seller undertakes to offer Products in compliance with current legislation and regulations and to deliver products that conform to the order. The Seller exercises the utmost care in selecting its suppliers and partners but cannot be held responsible for any incorrect information provided by its suppliers.

All products must be stored in a cool, dry place away from light. The Client must strictly adhere to the recommended storage conditions. The Seller cannot be held liable for improper storage conditions after delivery, consumption beyond the Best Before Date (BBD) indicated on all products, or any other case where the Client has not complied with hygiene rules communicated by the Seller or health authorities.

It is the Client’s responsibility to inquire before ordering, especially in cases of food intolerances or allergies. The composition of the biscuits and any potential allergens are specified on the descriptive page of each flavor.


Warranty

All products offered by TOUTOU BISCUITS on the website https://www.en-tete-a-truffe.fr/ are covered by the legal warranty provided by Articles 1641 et seq. of the French Civil Code.

In the event of non-conformity of a sold product, it may be returned to TOUTOU BISCUITS, which will take it back, exchange it, or refund it. All claims, exchange requests, or refund requests must be made by sending an email to: stelliepatisserie@gmail.com within thirty days of delivery.


Refund Policy in Case of Breakage

At Toutou Biscuits, we do everything possible to ensure your biscuits arrive in perfect condition thanks to reinforced packaging. However, due to the fragile nature of our products, minor breakages may occur. We do not refund orders where one or two biscuits are slightly damaged out of a large total.

However, in the event of excessive breakage, we commit to fully refunding the customer, provided that our customer service is notified immediately and photographic evidence is supplied.

Visibly damaged parcel: If the parcel arrives with obvious visible damage (e.g., crushed box, holes, or signs of severe deterioration), it is essential to refuse the delivery or immediately report the issue at the pickup point. By accepting a visibly damaged parcel, you risk losing your right to a refund, as the carrier is responsible for damages in cases of force majeure.

Parcel in apparent good condition: If the parcel appears to be in good external condition but you discover significant damage inside, please contact us within 48 hours of receipt, providing supporting photos. In this case, we will issue a refund or replacement after verification.

Carrier liability: In the case of delivery by La Poste or another carrier, any damage caused by the carrier must be reported immediately to their claims department. We cannot cover breakages resulting from transport conditions beyond our control. However, if the products are damaged despite intact packaging, we commit to refunding or replacing the affected items after contacting our customer service.


Liability

TOUTOU BISCUITS has, for all stages of access to the website, the ordering process, delivery, customer service, or subsequent services, only a best-efforts obligation. TOUTOU BISCUITS cannot be held liable for any inconvenience or damage inherent to the use of the internet network, notably loss of data, intrusion, viruses, service disruption, or other unintentional problems, or for any event qualified as force majeure under jurisprudence.

Computerized records kept in TOUTOU BISCUITS’s information systems under reasonable security conditions will be considered proof of communications, orders, and payments made between TOUTOU BISCUITS and the Client.


Security

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, we offer a consumer mediation system. The designated mediation entity is:

Pursuant to Article L612-2 of the French Consumer Code, one of the prerequisites for the mediator to examine the dispute is as follows: the consumer must demonstrate that they have first tried to resolve the dispute directly with TOUTOU BISCUITS’s customer service, by sending a complaint by postal mail or email according to the procedures defined in Article 16.

Force Majeure

The performance by TOUTOU BISCUITS of all or part of its obligations, notably delivery, will be suspended in the event of the occurrence of a fortuitous event or force majeure that hinders or delays execution.

Such events include, but are not limited to, war, riots, insurrection, social unrest, or strikes of any kind.

TOUTOU BISCUITS will inform CLIENTS of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. If the suspension continues beyond fifteen days, the CLIENT will have the option to cancel the current order, and the price of the ordered Products and paid delivery fees will then be refunded.


Applicable Law and Jurisdiction

The General Terms and Conditions of Sale are subject to French law. Only the French version of these General Terms and Conditions of Sale is legally binding. In the event of a dispute arising from the Order, the delivery of Products, or more generally the execution of the sale, the CLIENT will have the option, before any legal action, to seek an amicable solution, notably with the help of a consumer association or any other advisor of their choice.
